About These terms

These are the terms and conditions on which we sell our products to you. Please read these terms carefully before you submit your order to us.

1. Our contract with you

1.1          How we will accept your order.

Our acceptance of your order will take place when we email you confirmation of your order, at which point a contract will come into existence between you and us.

1.2          If we cannot accept your order.

This might be because: the product is out of stock, we have identified an error in the price or description of the product, there is an issue with your payment method.

1.3           Whilst we will try to keep display accurate product availability online, there may be occasions where a product is shown as available to purchase but there is no stock in shop. We recommend you check that the products you wish to order are available in the shop before paying for your order. If you do order a product that is not available, please contact our shop team.

1.4          Your order number.

We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

2.             Our products

2.1           We are under a legal duty to supply products that are in conformity with this contract and to be as described, fit for purpose and of satisfactory quality. As many of our products are perishable, you agree to comply with any instructions and recommendations we provide to you in relation to the storage and use of the products (for example and without limitation, use by dates). Our promises under these terms do not apply to products that have not been stored as per our instructions or once the use-by or best-before date has expired.

2.2           Product packaging may vary. The packaging of the product may vary from that shown in images.

Our food is supplied strictly for direct customer use. Under no circumstances is our food to be re-sold to a third party or offered at subsidised or inflated rates to a third party. This restriction also applies to in-house catering arrangements where contract caterers are ordering on behalf of clients.

3.             Providing the products

3.1          Collection.

You will be responsible for collecting your order from the Pret shop you are in. This includes products that require the input of our shop teams, including all barista-prepared drinks which will need to be collected from the shop teams once they have been prepared. Products must be collected at the same time as ordering.

3.2          When you become responsible for the product.

The product will be your responsibility from the time it has been collected by you either from our displays or from our shop team.

3.3          When you own the products.

You own the products once we have received payment in full and the email order confirmation has been received by you.

4.             Your rights to end the contract

Once the order has been accepted by us, you cannot end the contract. If the products do not meet the requirements in these terms, you may be eligible for a refund or exchange so please contact us (see section 6).

5.             Our rights to end the contract

5.1          We may end the contract if we cannot reasonably provide you with the products ordered. If there are no suitable alternatives, you will be eligible for a refund where your order was accepted but not fulfilled by us.

6.             If there is a problem with the product

6.1          How to tell us about problems.

If you have any questions or complaints about the product, please contact our shop teams in-store. If you are no longer at our shop, you can telephone our consumer service team at 0207 827 8801 or write to us at cs@pret.com  

6.2          Your right to reject.

If a product does not meet the terms set out in section 2 above, you have the right to reject them if the product use-by date has not expired or if you reject within 30 days of purchasing for products where the use-by or best before date falls more than 30 days after the purchase date. You may then be eligible for a refund or an exchange. Please contact us if you are not happy with any of the products you have ordered.

7.             Price and payment

7.1          Where to find the price for the product.

The price of the product (which includes VAT) will be the price set out on our online portal you use to place orders. This will be the same as the prices displayed in our shops. We take all reasonable care to ensure that the price of product advised to you is correct. If you believe a product has been incorrectly charged on your order, please contact us using the details above.

7.2          When you must pay and how you must pay.

We accept payment with Apple Pay, Google Pay and by most credit/debit cards. You must pay for the products before collecting.

7.3           There are no additional fees for using this online service so the price you pay will be the same price you would pay if paying with our shop team.

8.             Our responsibility for loss or damage suffered by you

8.1           Our liability in contract, tort (including, without limitation, negligence) or otherwise in respect of any products delivered or otherwise in connection with an order or for any loss, injury or damage attributable directly or indirectly thereto will at the sole option of us, be limited to: (a) replacement products (at our expense); or (b) refunding any sums paid to us for the products. In the event we cannot fulfil obligations to you under this agreement due to any event beyond our reasonable control, we will notify you and we will be relieved of our obligations to you under these terms and conditions to the extent such performance is hindered by such an event.

8.2          We do not exclude or limit in any way our liability to you where it would be unlawful to do so.

This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the goods.

8.3          We are not liable for business losses.

We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

9.             How we may use your personal information

9.1          We will only use your personal information as set out in our Privacy Policy

10.          Other important terms

10.1       Nobody else has any rights under this contract.

This contract is between you and us. No other person shall have any rights to enforce any of its terms.

10.2     If a court finds part of this contract illegal, the rest will continue in force.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

10.3       Which laws apply to this contract and where you may bring legal proceedings.

These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland, you can bring legal proceedings in respect of the products in either the Scottish or the English courts.
